Terms of Use & SMS Notification Terms

1. Use of the Site

You may access and use the Site for lawful personal or business purposes. You agree not to:

• Use the Site in a manner that violates any applicable law or regulation.
• Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems.
• Use automated means to scrape or harvest content from the Site without prior written permission.

The Site and its content — including text, graphics, code, and logos — are owned by Harebrained Apps or its licensors and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission, except as permitted by fair use.

3. Third-Party Links and Services

The Site may link to third-party websites or services. Harebrained Apps is not responsible for the content, policies, or practices of those third parties.

4. Disclaimer of Warranties

The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Harebrained Apps does not warrant that the Site will be uninterrupted, error-free, or secure.

5. Limitation of Liability

To the maximum extent permitted by law, Harebrained Apps will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site, even if advised of the possibility of such damages. Total cumulative liability arising from or related to the Site will not exceed one hundred U.S. dollars ($100).

6. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in King County, Washington.

7. Program Description

Forge by Harebrained Apps is a transactional SMS notification program that sends automated text messages to enrolled mobile numbers about workflow status events (for example: build complete, build failed, and error alerts) generated by the Forge agentic workflow system.

8. Opt-In / Consent

You enroll in Forge SMS by entering a mobile phone number in the Forge notification settings and affirmatively confirming consent. By doing so, you agree to receive automated SMS messages from Harebrained Apps related to your Forge workflows. Consent is voluntary and is not a condition of purchasing any goods or services.

9. Message Frequency

Message frequency varies based on workflow activity.

10. Message and Data Rates

Message and data rates may apply. Charges for messages are billed by your wireless carrier under your service plan. Harebrained Apps is not responsible for carrier charges.

11. Opt-Out

To stop receiving messages from Forge SMS at any time, reply STOP, CANCEL, QUIT, END, or UNSUBSCRIBE to any message. You will receive one final confirmation message acknowledging your opt-out, after which no further messages will be sent. You may also opt out by emailing privacy@harebrained-apps.com.

To resubscribe after opting out, reply START or UNSTOP, or re-enroll through the Forge notification settings.

13. Carriers

Forge SMS is available on AT&T, T-Mobile, Verizon, and other participating wireless carriers. Carrier support may vary. Carriers are not liable for delayed or undelivered messages.

14. Example Messages

The following are representative examples of the messages you may receive from Forge SMS:

• “Forge: Build ‘my-pipeline’ completed successfully. Deployed to production. Reply STOP to opt out.”
• “Forge: Build ‘my-pipeline’ FAILED. Check logs at https://harebrained-apps.com/forge/runs/[id]. Reply STOP to opt out.”
• “Forge: Error in workflow ‘daily-sync’ — NullPointerException at step 3. Reply STOP to opt out, HELP for help.”

15. Eligibility

You must be 18 years of age or older and a resident of the United States to opt in to Forge SMS. By enrolling, you confirm that you are 18 or older.

16. Privacy

Information collected in connection with Forge SMS is handled in accordance with our Privacy Policy. In particular: no mobile information will be shared with third parties or affiliates for marketing or promotional purposes; SMS opt-in data and consent will not be shared with any third party except aggregators and SMS-delivery providers used to send your messages.

17. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Material changes will be communicated through a notice on the Site or, where appropriate, by email or SMS to affected users. Continued use of the Site or Forge SMS after a change takes effect constitutes acceptance of the updated Terms.
